TERMS & CONDITIONS
The following GENERAL CONDITIONS regulate the sale and purchase agreement, between the seller Wiinki’s Beauty (Marisa Winckler – based on Av. Dr. Joaquim de Albuquerque 66, 2540-004, Bombarral – VAT 246166894) and the buyer that completed an order on the website www.wiinkisbeauty.com.
GENERAL CONDITIONS OF SALE:
By making purchases on the website, the buyer accepts these general conditions of Sale.
The Selling Price of the products includes VAT at the prevailing rate.
To the value of the product adds, when applicable, the cost of shipping and/or delivery.
The products for sale are described and presented according to their original characteristics and according to the information provided by the factory, and may not match the colors that the customer sees through the website.
The online selling platform is designed so that the customer knows in advance the availability of the product.
However, Wiinki’s Beauty cannot prevent stockouts, particularly those due to force majeure.
PASSING OF PROPERTY:
Wiinki’s Beauty shall retain the property of the goods until full payment has been made by the customer and has been received.
The customer will own the goods once full payment has been received by Wiinki’s Beauty.
The Wiinki’s Beauty packages are shipped via CTT or DHL.
Please allow 1-5 business days for your order to be processed and packaged before its shipment.
Purchases made during large releases and/or sales may take up to 10 business days to be processed and packaged before shipment.
Once you place your order, you will receive an order confirmation, to the accurate email address that you given. If you did not receive an order confirmation, you either did not provide us with a valid email address or your order did not go through.
Once your order is processed, a shipping label will be created and an email will be sent to the email address that you provided during checkout.
This email will contain a CTT or DHL tracking number and additional shipping information.
Please allow approximately 24 hours for tracking information to become available.
PLEASE NOTE that all of our shipping times are NOT guaranteed.
ONCE YOUR ITEMS ARE AT THE MAIL SERVICE, THE PACKAGE IS NO LONGER THE RESPONSIBILITY OF WIINKI’S BEAUTY.
WE WILL NOT REPLACE LOST OR STOLEN PACKAGES. FOR INTERNATIONAL ORDERS, THE BUYER ACKNOWLEDGES RESPONSIBILITY FOR ANY IMPORT OR CUSTOMS FEES AND/OR TAXES.
You must comply with all applicable laws and regulations of the country for which the Products are destined. We will not be liable or responsible if you break any such law.
Payments may be made by one of the following payment methods: VISA, Master Card, American Express or via PayPal.
Discount codes are non-transferable and bear no cash value.
Any discount code sent to you by email or any other method is confidential and the Customer shall not share this with any other person. We reserve the right to reject or cancel any orders which do not comply with our terms even if your credit or debit card has been charged (and will refund in full any amounts paid by you in respect of the order).
If there are delays in the delivery caused by the supplier, the carrier or any other third party, Wiinki’s Beauty are not be liable for such delay.
All purchases made will be delivered to the address provided by the consumer at the checkout.
Wiinki’s Beauty accept no liability for undelivered parcels where the Customer provides an incorrect or invalid delivery address and/or fails to collect the order from the delivery address. Deliveries are made during business hours (9am to 7pm), depending on the shipping company (DHL OR CTT) and the carrier’s route.
RETURNS OR EXCHANGES:
For sanitary reasons, Wiinki’s Beauty does not accept returns or exchanges.
All sales are FINAL.
DAMAGED PRODUCTS OR INCOMPLETE ORDERS:
The customer must check, WITHOUT EXCEPTION, the package and its contents upon delivery and immediately submit a complaint to the carrier if it has signs of damage.
In case of damaged item(s), caused by poor transportation conditions, you must send supporting photographs and the signature and consentment of the carrier’s, to the email address email@example.com, upon the approval of the carrier.
If your order is incomplete, the SAME CONDITIONS are imposed as the damaged items and you must contact our customer support line firstname.lastname@example.org. We will receive the return of damaged product(s), if all of the following steps are provided:
– Within 5 working days from the reception of the order by customer;
– Must be ‘as new’, in the original undamaged/unopened packaging and followed by its receipt.
The return must be registered in advance with the Wiinki’s Beauty helpline, by email email@example.com, indicating the order number, the products to be returned and the supporting pictures and signature / consentment of the carrier’s, for poor transportation conditions.
All shipping costs related to transportation of the damaged material(s), are of the sole responsibility of the customer.
When applicable, the value of the product(s) damaged (prevailing price of the transaction) will be refunded within 15 days from verification and confirmation by Wiinki’s Beauty.
Your Gift Card will be sent instantly following our receipt of payment to the email address that you provided us when ordering.
If you want a gift card to be sent to your address, please let us know on the order notes, your shipping address and other extra notes.
When placing and order for Gift Cards, take in consideration the shipping costs available.
Gift Cards cannot be purchased using another Gift Card, a discount voucher or other such promotional codes.
Gift Cards can only be used one time.
Payment with your Gift Card
Gift Cards may be used in conjunction with other payment types.
If your order value is greater than your Gift Card balance, you can use an alternative payment method to cover the difference.
You need to use the full balance in a single transaction.
Refunds, Returns & Expiry
Gift Cards cannot be refunded or returned.
Gift Cards are valid for 6 months from date of issue.
Stolen Gift Cards
Wiinki’s Beauty is unable to replace any lost or stolen Gift Cards.
We reserve the right to refuse any Gift Card that is suspected to be tampered with or deemed fraudulent.
Gift Cards that have the original payment reclaimed or refused will be cancelled.
Re-sale of Gift Cards
Gift Cards cannot be offered to any third parties for sale or otherwise for monetary or other value or as part of a promotion, competition, auction or similar activity by the customer (or any person to which the Gift Card has been gifted by the customer).
Wiinki’s Beauty reserves the right to refuse or suspend any Gift Card which we know or suspect has been used for this purpose.
The customer shall respect all licence agreements delivered by the copyright owners.
Wiinki’s Beauty cannot be held responsible or liable for any misuses conducted by the Customer or any third party. All trademarks shown on www.wiinkisbeauty.com belong to their registered owners and must not be copied without prior permission.
You must not use any part of the materials on the Online Store for commercial purposes without obtaining a licence to do so from us or our licensors.
RESPONSIBILITY FOR THE INTERNET USE:
Wiinki’s Beauty has no responsibility for any damages or problems arising from use of the Internet, such as external intrusions or computer virus.
CHANGES TO TERMS & CONDITIONS:
We reserve the right to change these terms and conditions at any time but will notify you in advance of such changes.
LAW AND JURISDICTION:
These terms and conditions are governed and shall be interpreted in accordance with the Portuguese Law and shall be subject to the non-exclusive jurisdiction of the courts of Portugal.
Any person attempting to make fraudulent credit card transactions will be prosecuted with no exception.
